• Terms & Conditions of Service

These Terms & Conditions of Service apply to all landscaping, lawn care, installation, maintenance, drainage, irrigation, lighting, cleanup, and related services provided by Citruscapes Lawn & Landscaping (“Citruscapes,” “we,” “us,” or “our”). By accepting a proposal, estimate, work order, or scheduling services with Citruscapes, the customer (“Customer,” “you,” or “your”) agrees to the following terms.

    1. Estimates & Proposals

All estimates and proposals are based upon the information and site conditions reasonably visible and accessible at the time of the estimate.

    Unless otherwise stated in writing:

    • Estimates are valid for 30 days and may be subject to change thereafter.
    • Pricing is based on the scope of work specifically described in the proposal.
    • Any work, materials, labor, or services not specifically included in the proposal are considered additional work and may result in additional charges.
    • Estimates do not include unforeseen site conditions, hidden obstructions, underground utilities, unsuitable soil, buried debris, irrigation issues, drainage problems, or other conditions that could not reasonably be identified during the initial estimate.
    • Changes to the scope of work requested by the Customer may require a revised estimate or change order.

    2. Scheduling & Project Start

Project scheduling is based on availability, weather, material availability, permitting, and other operational considerations.

Citruscapes will make reasonable efforts to begin and complete work within the anticipated timeframe provided to the Customer. However, scheduled dates are estimates and are not guaranteed.

Weather, storms, material delays, plant availability, equipment issues, employee availability, permitting, or other circumstances beyond our reasonable control may result in scheduling changes.

    3. Customer Responsibilities

    The Customer is responsible for:

    • Providing Citruscapes with reasonable access to the property and work areas.
    • Identifying any known underground utilities, private irrigation lines, electrical wiring, drainage systems, septic systems, wells, or other concealed improvements not identifiable through standard utility marking procedures.
    • Removing or securing personal property, decorations, furniture, toys, vehicles, or other items from the work area before work begins.
    • Providing access to necessary water and electrical sources when required for the agreed scope of work.
    • Obtaining any required approval from homeowners’ associations, property managers, landlords, or other governing entities unless otherwise agreed in writing.

Citruscapes is not responsible for damage to unmarked or improperly marked private utilities, irrigation systems, wiring, drainage systems, or other concealed improvements.

    4. Plants & Landscaping Materials

Plant availability, size, color, shape, and appearance may vary based on seasonal availability and nursery inventory.

When a specific plant, size, or material is unavailable, Citruscapes may recommend a reasonably comparable substitute. No substitution will be made without Customer approval when the substitution materially changes the scope or appearance of the project.

Natural variations in plants and landscaping materials are not considered defects. These may include differences in color, size, shape, growth habit, foliage density, or minor imperfections.

Plants are living materials and their survival depends on proper watering, drainage, soil conditions, weather, pests, disease, fertilization, and ongoing care.

    5. Plant Warranty & Guarantee

Unless a specific written warranty is included in the proposal, Citruscapes does not guarantee the survival of installed plants, trees, palms, sod, or other living landscape materials.

Where a plant warranty is specifically provided in writing, the warranty is subject to its stated terms and exclusions.

Plant warranties generally do not cover loss or damage caused by:

    • Insufficient or excessive watering
    • Drought, freezing temperatures, excessive heat, storms, hurricanes, flooding, or other weather conditions
    • Improper irrigation or irrigation system failure
    • Pests, insects, disease, fungus, or wildlife
    • Damage caused by pets, people, vehicles, lawn equipment, or third parties
    • Improper maintenance performed by others
    • Soil or drainage conditions
    • Acts of nature
    • Failure to follow watering or care instructions provided by Citruscapes

Replacement plants, when covered under a written warranty, may be limited to the original plant type and size specified in the proposal.

    6. Irrigation & Watering

The Customer understands that newly installed plants, sod, trees, and other living materials require adequate and consistent watering.

Unless irrigation maintenance is specifically included in the proposal, the Customer is responsible for ensuring that the landscape receives adequate water following installation.

Citruscapes is not responsible for plant or sod loss resulting from inadequate watering, irrigation malfunction, water restrictions, or failure to follow provided watering recommendations.

Citruscapes is not responsible for pre-existing irrigation deficiencies unless specifically included in the scope of work.

    7. Drainage & Irrigation Work

Drainage and irrigation systems are designed based upon visible site conditions and the scope specified in the proposal.

Citruscapes does not guarantee that drainage improvements will eliminate all standing water or resolve conditions caused by excessive rainfall, groundwater, poor soil conditions, elevation limitations, neighboring properties, or other conditions outside the installed system.

Existing irrigation, drainage, electrical, plumbing, and underground systems may contain concealed defects or damage. Repairs to such conditions that are outside the original scope may result in additional charges.

    8. Landscape Lighting

Landscape lighting installations are subject to existing electrical conditions, transformer capacity, wiring locations, underground obstructions, and other site conditions.

Citruscapes is not responsible for pre-existing electrical problems or damage to concealed utilities or wiring not identified before installation.

Any warranty on lighting fixtures, transformers, wiring, or related components will be limited to the manufacturer’s warranty unless a separate written warranty is provided by Citruscapes.

    9. Existing Conditions

Citruscapes is not responsible for damage to existing landscape features, irrigation, drainage, electrical systems, hardscape, structures, underground utilities, or other property when such damage results from pre-existing conditions, improper installation, concealed defects, or unmarked private utilities.

Reasonable care will be taken to protect existing property and landscaping during the performance of services.

    10. Change Orders & Additional Work

Any work requested by the Customer that is outside the original proposal may be treated as additional work.

Additional work may include, but is not limited to:

    • Additional plants or materials
    • Additional excavation
    • Removal of unforeseen debris or roots
    • Repair of concealed irrigation or drainage issues
    • Additional grading or soil preparation
    • Additional cleanup
    • Changes to the original landscape design
    • Additional labor or equipment

Citruscapes will communicate additional costs to the Customer whenever reasonably practical before proceeding.

    11. Payment Terms

Payment terms will be specified on the applicable proposal, invoice, or service agreement.

    Unless otherwise stated:

    • Payment is due according to the terms listed on the invoice or proposal.
    • Deposits or progress payments may be required before materials are ordered or work begins.
    • Final payment is due upon substantial completion of the contracted work.
    • Past-due balances may be subject to applicable late fees, collection costs, or other charges permitted by law.
    • The Customer agrees to pay reasonable costs associated with collection of unpaid balances to the extent permitted by law.

Citruscapes reserves the right to suspend work or services on accounts with outstanding balances.

    12. Deposits & Material Orders

Deposits may be required to secure scheduling and purchase materials.

Once special-order materials, plants, fixtures, or other products have been purchased specifically for a project, those items may be non-refundable or subject to applicable restocking, cancellation, or supplier fees.

Any refund or cancellation will be handled in accordance with the terms stated in the applicable proposal and applicable law.

    13. Cancellations & Rescheduling

Customers should provide reasonable notice when requesting cancellation or rescheduling.

Citruscapes reserves the right to charge applicable cancellation, restocking, mobilization, or other reasonable costs associated with a cancellation or rescheduling, particularly when materials have already been purchased or crews have been scheduled.

    14. Weather & Acts Beyond Our Control

Citruscapes may delay, reschedule, or temporarily suspend work due to weather or unsafe working conditions.

This includes, but is not limited to, hurricanes, tropical storms, heavy rain, flooding, lightning, high winds, extreme temperatures, freezes, drought conditions, or other severe weather.

Citruscapes is not responsible for delays, plant loss, property damage, or other conditions resulting from circumstances beyond our reasonable control.

    15. Cleanup & Debris

Cleanup will be performed according to the scope stated in the applicable proposal.

Unless specifically included, removal of pre-existing debris, construction materials, hazardous materials, excessive quantities of soil, concrete, rock, or other materials outside the anticipated scope may result in additional charges.

    16. Property Access

The Customer authorizes Citruscapes and its employees, contractors, and equipment to access the property during scheduled service times for the purpose of performing contracted services.

The Customer is responsible for providing access to gated or restricted areas unless alternative arrangements have been made.

Citruscapes may be unable to perform scheduled services when reasonable access is unavailable.

    17. Photographs & Project Documentation

Citruscapes may photograph completed landscape projects for documentation, quality control, portfolio purposes, website content, and marketing unless the Customer requests otherwise in writing.

Photographs will be used primarily to display the landscaping work and will not intentionally disclose private personal information.

    18. Customer-Supplied Materials

When the Customer supplies plants, mulch, rock, sod, irrigation materials, fixtures, or other products, Citruscapes is not responsible for defects, quality, quantity, suitability, or performance of those materials.

Citruscapes will install Customer-supplied materials with reasonable care; however, replacement or additional labor resulting from defective, insufficient, damaged, or unsuitable Customer-supplied materials may be charged separately.

    19. Sod Installation

Sod is a living product and requires immediate and consistent watering following installation.

Citruscapes is not responsible for sod failure caused by inadequate watering, irrigation problems, weather, soil conditions, pests, disease, improper maintenance, or other conditions outside our control.

Unless specifically included, ongoing watering and maintenance following installation are the Customer’s responsibility.

    20. Maintenance Services

For recurring lawn or landscape maintenance services, the Customer agrees to maintain a reasonably accessible property and notify Citruscapes of conditions that may affect service.

Maintenance schedules may be adjusted seasonally due to grass growth, weather, holidays, storms, or other operational conditions.

Citruscapes reserves the right to suspend or modify services when conditions are unsafe for employees, equipment, or the property.

    21. Right to Refuse or Suspend Service

Citruscapes reserves the right to refuse, suspend, or discontinue services when:

    • The property presents unsafe working conditions.
    • The Customer has an unpaid balance.
    • Access to the property is unavailable.
    • Requested work falls outside our services or licensing requirements.
    • Conditions exist that could reasonably cause injury, property damage, or equipment damage.
    • The Customer or another person on the property engages in threatening, abusive, or inappropriate behavior toward Citruscapes employees or contractors.

    22. Limitation of Liability

To the extent permitted by applicable law, Citruscapes’ liability for claims arising from services provided will be limited to the amount actually paid by the Customer for the specific service giving rise to the claim.

Citruscapes will not be responsible for indirect, incidental, consequential, or special damages to the extent permitted by law.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.

    23. Disputes

The Customer and Citruscapes agree to make reasonable efforts to resolve any dispute or concern directly and in good faith before pursuing formal legal remedies.

Nothing in these Terms limits either party’s rights under applicable Florida law.

    24. Changes to These Terms

Citruscapes may update these Terms & Conditions from time to time. The Terms in effect at the time services are accepted or performed will generally apply to that service unless otherwise agreed in writing.

    25. Acceptance of Terms

Acceptance of a Citruscapes proposal, estimate, work order, service agreement, invoice, or scheduling of services constitutes acknowledgment that the Customer has had an opportunity to review and agrees to these Terms & Conditions of Service.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
